  • Alerted by the Maritime Fire Brigade, the São Paulo Port Captaincy radioed the merchant ship Coral, which was nearby and rescued the four people.

The news

The recreational boat Águia VII, which had left Guarujá, capsized on the morning of Sunday, October 25, about 88 nautical miles (roughly 163 km) off Ilhabela, on the northern coast of São Paulo state. The four occupants were on the upturned hull when they were found.

According to the Brazilian Navy, through the São Paulo Port Captaincy, the alert came from the Maritime Fire Brigade (GBMar). The Captaincy radioed Coral, a Singapore-flagged merchant ship sailing in the area, and the ship's crew carried out the rescue.

Coral continued to the Port of Santos. There, the four were transferred to a Captaincy vessel and taken ashore. The arrival operation involved pilots, the Santos Port Authority and tug companies, according to local media. According to the Navy, no one showed injuries or signs of drowning. The cause of the accident was not disclosed.

Why it matters

The case shows a less visible side of shipping: the merchant ship as part of the search and rescue system. The International Convention for the Safety of Life at Sea (SOLAS) requires a master who receives a distress call to proceed to assist people in danger. On the high seas, far from rescue bases, the nearest ship is often the first to arrive.

For cargo owners, a rescue can cost hours. The shipping rules used in many bills of lading, such as the Hague-Visby Rules, treat deviation to save life at sea as permitted, not as a breach of contract. It is not yet known whether Coral had to change course or whether Santos was already its destination.

The Navy used the case to repeat its advice to boaters: carry out preventive maintenance, check lifesaving equipment, follow the weather forecast and heed bad weather warnings. Emergencies at sea can be reported on 185.

What to do

  1. 1If your cargo is on a ship that took part in a rescue, ask your agent for the new arrival estimate. Deviation to save life is usually permitted under bills of lading and does not give a right to compensation for the delay.
